law change, changes for dogs, too?
Hi
Well a little while ago the law changed here in oklahoma and I was wondering if this has any affect on the dogs, too. I forgot the exact law title but i hope you understand iof I describe it. Here in Oklahoma you weren't allowed to shoot someone if he wasn't in your house threatening you, now the law changed and you can shoot someone outside. My question now is, the dog if he attaks is concidered a deadly weapon... If someone threatens me, do i still have to drag him inside when he got bit? or can i leave him outside? (Just kidding)but do you think there is some effect for dogbites in protection cases? |

I'm not exactly sure how one relates to the other but.....
First thing... I am not a lawyer. Is a dog a deadly weapon? It depends on how the dog was trained and what a jury would decide (considering you are trying to establish a level of culpability). Police dogs are not considered deadly force as they are not trained to kill (there has been one incident on the books of a police K9 causing a death) Could the owner of a schutzhund trained dog be charged with murder? Yes. http://www.leerburg.com/rot-kill.htm As for defending yourself against an attack, you are legally allowed to use one level of force above what you are being threatened with. If you are being threatened with a deadly weapon, you would probably be justified to have your dog attack. This is probably a little safer now that Oklahoma has the Castle Doctrine (to tie your question together) as it offers you protection from prosecution and civil liability. Do not drag the bad guy in to your house after your dog attacks him. |

never been to lawton. I would go there but its like a two hour trip cause theres no straight shot. I have to go through lots of little towns. I may be going there to help my friend pick up her stuff out of storage. She had to leave most everything there when she moved back. I will let you know if I head that way maybe we could have lunch or coffee or something
