Need Advice, QUICK!!

Ok, a friend (buyer) of mine is getting a puppy. JRT. She put a $50 deposit down on this pup to hold him until he is 8 weeks old(he's like 7 now). The seller told her puppy had to visit the vet one last time before his 8 weeks and then buyer could pick him up at 8 weeks. Well, buyer has been trying to reach the seller to see how the vet visit went, make sure puppy is well and an idea of what day he would be ready so she can drive down to get him, and cannot reach her. Buyer's called seller at least 4 times a day, and once even got her mother on the phone (who lives with her) and her mother said she would pass the message along. Well, buyer heard seller talking in the back ground. Needless to say, the buyer is frustrated and doesn't know what to do. Buyer asked me what I would do, but I honestly don't know what to tell her. Buyer is about to call seller and say she wants her money back because seller has not returned calls in days, and keep looking for a different puppy. Buyer has looked at other pups, and is about to just say forget the $50.

Anyone have any suggestions about what to do? I'm just stumped and figured I would ask you guys.

I hope your friend got a receipt for that deposit, or at least wrote a check instead of paying cash. The reciept can hold up with the law, and the check can be canceled, and if she cashed it, that too can stand up in a court of law. Small claims court would be the way to go.
I keep telling people NEVER do business with anyone, not even if they know the person, without proper contracts and receipt's.

What is the sellers policy on deposits? It should be on the receipt. When we had our litter we gave a receipt of deposit and on that receipt it statd it was nonrefundable. Granted I would have refunded the money but it stated it was nonrefundable. Make sure that hers does not say this.

other then that I would tell her to either get her $ back or let it go but would NOT get a dog from this "breeder". This "breeder" seems shady at best.

Alot of red flags to me, I would have your friend do more research on breeders, and look for a COE breeder. Forget the money

I would stop by the "breeder's" house and request my deposit back, and then involve the law if she refuses. Did she sign a contract or anything that stated she comitted to take a pup or her deposit was non-refundable?

I just hate, hate, HATE these BYBs!

Is the puppy registered with AKC or the breed Club? I would report the breeder to the registery. If the deposit is unrefundable, it would be so if the buyer changes her mind not the seller.

Well, the breeder finally called my friend back last night. Said she was at the Vet's. My friend has another pup to look at also. I'm not sure what she is going to do. The breeder said the pup will be ready for her to pick up any time, the Vet gave the OK to be placed in homes. I don't know what to tell her. I guess that will just take some time. Either way, from one pup or the other, my friend is picking up a JRT puppy today/tonight. I was supposed to go look at the other pup last night with her, but my tire was flat, my boyfriend had to pick me up, and last night just SUCKED!!! I will keep all posted on what my friend does, as I'm not sure what she's going to do either.

Update!!!

Ok, my friend asked me to go with her when I took my lunch break to pick up the puppy.

He looks healthy, and the breeder had ALL of his records. "Barley" is happy and healthy, just they way a puppy should be. I am SOO glad my friend didn't get screwed over, because that would just be horrible. Barley will also be registered, and the breeder gave my friend some sort of health guarantee (I can't remember what exactly, but I know it was legit).

I will post pictures later!!

sounds sketchy but maybe the breeder not wanting to talk to your friend had nothing at all to do with the puppies or your friend (e.g. personal crisis).

Barley is such a cute name. Hope you can post pics soon
