food for thought- a 2 year old girl climbed an 8 foot privacy fence (tresspassing).
The dog in the fence bit her... the dog was euthanized and the parents of the girl sued the owners of the dog. They won....even though she was tresspassing! im not saying thats the way it should be, but sometimes thats how it is... criminals have sued over injuries on broken stairs in a house they had robbed and won... its not right....imo |

Deffinately think the dogs have the right!!! After all they're protecting!!! It's no different than if someone barged into your home and tried to knife you and you knocked them out with a frying pan, you did it out of defense!

And this is where I think our judicial system sometimes has...issues. I've heard of more than one incident in which a dog that bit a trespasser (a *robber*, even) was labeled dangerous, the owners were held responsible, and the animal was even put down. Makes no sense to me at all.
A friend in a criminal justice class came back with *this* interesting little story - a cat burglar literally suing and WINNING his case, after falling through the skylight pf the house he was attempting to burglarize, and landing on a knife that was left out on a cutting board. What on earth could the charges have been? Reckless endangerment of would-be criminals? The story was so bizarre that I have trouble believing it's true, but according to her professor, it certainly is, and is in the case books. |

In this case it would depend on the state and the judge/jury. It could go either way. I don't like it, but that seems to be the way it is. My theory, is that if you are breaking the law, you voluntarily gave up your rights at that point by violating mine or someone else's. I'd hope my dog would rip their freaking arm off and throw in a few crotch bites for fun, just to make sure our gene pool doesn't get any more screwed up, if somebody broke into my house.

It is definitely the trespasser's fault. I know that if anyone ever tried to break in, Colby would tear them to bits - she is very protective of her family and home - and I don't think if she ever does that that she should be labeled dangerous. All she'd be doing is protecting her family and that's what she's supposed to do.

Absolutely Linnie. The trespassers (even the little girl, as sad as it is to see a child hurt) are the ones to blame. The dogs did nothing wrong, they did what they were suppose to do really...protect their family and property.
Neither the little girl nor burglar (especially the criminal) had the right to be on the property and (unfortunately for the little girl) they suffered the consequences. I wonder how many 'dog people' would sue someone if they trespassed on property and got bitten? None, I should think (well...maybe a few greedy so-and-so's but for most of us it would be unlikely). Here's an idea...outlaw lawyers. ROFL!! Perhaps that would solve things. Or we could sue them all for the suffering they cause us. Cass. |
